Terms of use

Before the GabyGaby Art website www.gabygabyart.com can be made available to you, we require you to agree to and abide by the requirements “Terms” set out below. If you don’t agree to these Terms, you can’t use GabyGaby Art

The Basics
You must be 18 years old or older to use GabyGaby Art or you must have a legal guardian agree that you can use GabyGaby Art.

Businesses are also allowed to use GabyGaby Art and make purchases. If you are using GabyGaby Art on behalf of a business you must have authority. Your use of GabyGaby Art is a warranty that you have the authority, to bind that business to these Terms.

You will be responsible for all activity occurring under your user-name and password. We can only identify you by your user-name and password, we therefore recommend that you don't allow others to use your user-name and keep your password secure and to yourself.

We want to create a community at GabyGaby Art, we therefore won’t tolerate users that abuse, impersonate, threaten or harass other GabyGaby Art users or users that act in any way we think is outside of these Terms or the spirit of GabyGaby Art.

Because the internet is available nearly everywhere, it is impossible to keep up with all legal requirements that may apply to use of GabyGaby Art. Therefore we put the onus on you to ensure that your use of GabyGaby Art complies with all laws, rules and regulations that are applicable to you. These Terms are void and use of GabyGaby Art is revoked where use is prohibited.

GabyGaby Art has to reserve the right to change these Terms. We will do our best to let you know when changes are made. We expect you to review these Terms periodically to make sure that you understand the agreement between us. If you continue to use GabyGaby Art after we have posted new Terms, you acknowledge that you agree to those new Terms.

Other policies, guidelines, requirements and FAQ's are posted elsewhere on GabyGaby Art from time to time. We expect that you agree to and abide by any other requirements posted on GabyGaby Art. All of those policies, guidelines, FAQs and other requirements are incorporated into these Terms.

If there is something posted on GabyGaby Art that you don't like, you may navigate away from that page. We can’t be held responsible for the impact anything posted on GabyGaby Art may have on you.

Do’s and Don’t’s
 When using GabyGaby Art …

Do's:
All the registration information and all other information posted or submitted to GabyGaby Art must be accurate, truthful and up-to-date. As we rely on this information we expect you to let us know when any of your information changes.

Re-post images from GabyGaby Art on other websites. We think that it benefits our artists and therefore support this practice. As long as you include a link back to GabyGaby Art and the page on which that image or content appears (and otherwise comply with these Terms) we agree with your re-posting of content, thumbnails, links to GabyGaby Art etc., in your blogs, social-network postings, listings, etc.

You are solely responsible for your conduct on GabyGaby Art. This includes any data, text, information, user-names, graphics, profiles, audio and video content that you post, submit or display on GabyGaby Art.

If you use any of the community features of GabyGaby Art, like commenting or social networking, be aware that any personal information (name, address, phone number, email address) that you elect to share will be shown to all other users of GabyGaby Art. So don’t post anything you don't want the public to see.

Don’t:
Infringe our artists’ rights. If you reproduce or sell images of their artwork, or post their artwork to other sites without a link back to GabyGaby Art you’ll be infringing their copyright and other rights to their art. This is illegal. As mentioned above; under conditions we do give you the limited right to re-post images from GabyGaby Art.

Infringe other people’s rights either. Don’t infringe upon any third party's copyright, patent, trademark, trade secret or other proprietary or intellectual property rights or rights of publicity or privacy.

Abuse our site. You may not use GabyGaby Art for hosting graphic elements of web page designs, icons, smileys, buddy icons, forum avatars, badges and other non-photographic elements on external websites. Nor may you modify, adapt, disassemble or otherwise change or interfere with the use of GabyGaby Art.  You are not allowed to interfere with or disrupt GabyGaby Art nor violate the security, servers or networks of GabyGaby Art.

Lie, cheat or steal-1. You cannot do anything on GabyGaby Art that involves the sale of illegal, counterfeit, stolen items or any other thing that is fraudulent. This includes artists misrepresenting work as their own and buyers attempting to reproduce an artist's artwork.

Lie, cheat or steal-2. Do not act in any other way than within the spirit of GabyGaby Art and described in these Therms. Don’t abuse, impersonate, threaten, libel, defame or harass other GabyGaby Art users. 

Lie, cheat or steal-3. Do not post, display or submit anything that is offensive, obscene, vulgar, false, inaccurate, misleading, defamatory, trade libelous, unlawfully threatening or harassing, profane or otherwise not appropriate as determined by us.

Falsely represent. Don't impersonate any other user, person or entity.

Break the law. Do not violate any law, statute, ordinance or regulation (this includes but is not limited to those governing export control, anti-discrimination, consumer protection, false advertising or unfair competition).

Hack. Do not upload, display or post any viruses, worms, Trojan horses, time bombs, cancel-bots, Easter eggs or any other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information.

Ruin it for the rest of us. Don’t create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers.

Spam anyone. Do not create or submit through GabyGaby Art or otherwise use GabyGaby Art to engage in any unwanted email solicitations, spam or other business that has no relation to GabyGaby Art.

Misuse our name. Do not link to GabyGaby Art in a way that could create an association between GabyGaby Art and another site. Nor should you indicate GabyGaby Arts approval, endorsement or any other relation to another site.

Artists’ Rights
At all times our artists retain the copyright to their artwork. Buying a piece of art does not transfer the copyright or any other rights. Images of artwork purchased on GabyGaby Art may not be reproduced in any way without the artist’s prior written consent.
It is for artists not possible to post their materials directly to GabyGaby Art.

Our Rights and Responsibilities
We will do our best to make GabyGaby Art available to you at all times. Whenever GabyGaby Art is not available, your content is removed or we need to make updates of any kind to GabyGaby Art, we will always try to have GabyGaby Art up and running again as soon as possible.

If you violate these Terms, the spirit of these Terms or for any other reason or no reason at all GabyGaby Art reserves the right to terminate your account and username. We have the right to choose our customers and may refuse service to anyone for any reason at any time.

If for any reason we need to change or discontinue certain aspects of GabyGaby Art we may do so with or without notice to you.

We are not able to review everything that gets posted to GabyGaby Art. We therefore may, but have no obligation to, remove content and accounts that we in our sole discretion believe is offensive, libelous, threatening, unlawful, defamatory, obscene or otherwise violates or objectionable any party's intellectual property, these Terms, the Privacy Policy or other policy documents and community guidelines as posted on GabyGaby Art. For example content includes items, items descriptions and information submitted in the forums.

By deleting your account you can remove your profile at any time. Deleting your account results in removing any private information you have stored in the system. We do not have the obligation to remove any comments or other postings that you have made on GabyGaby Art.

Uploading Content to GabyGaby Art means you agree to allow other GabyGaby Art users to view and comment on the Content and you agree to allow GabyGaby Art to display, store, modify, reformat, distribute and otherwise use and exploit the Content on GabyGaby Art forever as we see fit.

GabyGaby Art, including all content, trademarks, logos, designs, graphics, images, audio, video, software are owned by us and our licensees. GabyGaby Art is protected by Dutch and international copyright laws. All rights are reserved by us and our licensees.

We may cooperate with law enforcement, court, third party or government investigations if we are requested or directed to comply and if we feel that is in the best interest of GabyGaby Art.

Third Party Services
GabyGaby Art may contain links to websites outside GabyGaby Art. We also may enable you to use third party services, such as Twitter, Face-book, blogging sites, emailing content etc. Whenever you use a link to another website or or the mentioned third party services you are no longer dealing directly with GabyGaby Art. You always should review the terms of service and privacy policies of any such third party provider before using any of these features.

Checkout, Shipping, Returns, Gift Certificates
Our expertise is art not the processing of payment transactions. We therefore use a third party to process the payments for purchases that you make on GabyGaby Art. This third party has its own separate Terms and Conditions that you need to agree to as part of the checkout process. GabyGaby Art is not responsible for the Terms and Conditions of this third party nor for the security and privacy of any credit card or other personal information that you submit through them.

 We will ship your order in accordance with your requests at checkout. All orders are subject to our Shipping Policies.

Returns and refunds are governed by our Return Policy.

Privacy
We take privacy seriously. In our Privacy Policy we describe how we handle information about you; so please review this. As we mentioned before we don’t actually do the payment processing ourselves. You therefore should refer to the Terms and Conditions of our provider to know how they will handle your credit card and other important information.
